Terms of Use

This website has been created by Medialab Prado (Dirección General de Proyectos Culturales, Área de Gobierno de las Artes, Ayuntamiento de Madrid) for informational purposes for personal use free of charge. Access to and use of website contents are the sole and exclusive responsibility of the user and imply the user’s knowledge and acceptance of the following terms:

1.Ownership

www.medialab-prado.es is an Internet domain owned by Medialab Prado (Dirección General de Proyectos Culturales, Área de Gobierno de las Artes, Ayuntamiento de Madrid), (hereinafter MEDIALAB) domiciled at Calle Alameda, 15, Madrid 28014.

2. Limitations on use

The user agrees to use www.medialab-prado.es in compliance with prevailing legislation, in good faith, public order, and generally accepted practices and customs.

If the user is under age, permission must be obtained from the user’s parents, guardians or legal representatives, who will be considered liable for all acts carried out by the minors in their charge.

The users who access this website are authorized to see all its information and contents, as well as download or reproduce it on their computers, in compliance with intellectual property legislation and the terms of the Creative Commons licence (creativecommons.org).

MEDIALAB reserves the right to prohibit or prevent access and shut down or block the account of any user who adds any content to the website that is not in compliance with prevailing legislation, these terms of use, or moral rights and will cooperate with the authorities in identifying any person who add contents to the website that may be an infringement on the law.

3. Liabilities

MEDIALAB will be liable solely for information contained on this website generated by the centre and will not be responsible for opinions contributed by users via forums or other participatory tools that may be developed. 

MEDIALAB is not obliged to accept all requests for registration from users, and may establish user registration criteria related to time limits, contents, or of any other nature it deems suitable.

For all projects and publications, the user agrees to comply with prevailing legislation is required at all times to adhere to the legislation current in their country of residence, also of the country in which the website is based, and any other geographical location where the content might have effect. The user is
solely responsible for the published content and undertakes to indemnify
the website owner for any loss or damage or other liabilities which may
arise from actions or negligence on the part of the user. The user may not include harmful code in the website content even if software filters exist which can deactivate such code.

The user undertakes not to carry out any direct or indirect advertising on
behalf of third parties. The published content should respect and be
consistent with the aims and intentions of www.medialab-prado.es.
The user undertakes to keep the necessary digital backups and copies of his or her works and publications. The website owner will not be held responsible for
the user’s failure to keep a security copy.
MEDIALAB is not liable for any damages of any nature suffered by the user or third parties arising from:

  • The lack of availability, maintenance or proper functioning of www.medialab-prado.es, its services or contents
  • The lack of usefulness, truth, suitability or validity of www.medialab-prado.es, its services or its contents to meet the user’s needs or expectations
  • The existence of viruses or other elements that might cause damage to computer systems, electronic documents or the user files on this website or third parties’ websites.
  • A third party who, infringing the security measures established by MEDIALAB, uses www.medialab-prado.es, its contents or services to transmit viruses, or who gains access to carry out any unauthorized treatment of data stored by MEDIALAB
  • Or in general any use of www.medialab-prado.es, its services and/or contents made by a user or third party that is not incompliance with the terms of access or use of same established by MEDIALAB

The links displayed on this website are to be considered solely as informative given that they are merely alphanumerical chains and should in no way be taken to constitute public communication, and are governed by Spanish law 34/2002, dated 11th July, on Information Society Services.
Such links are displayed on the website with the intention of complying
with the nature of the Internet, in order to integrate the website into
same, for reasons of search engine positioning and for information
purposes. The inclusion of these external links will not imply any type of association, merger or investment of MEDIALAB with the linked entities.
MEDIALAB will not be held liable for the truth, utility, quality, reliability or legality of the content of any external site accessed through a link, notwithstanding its compliance and legal obligations in case the content on the link is declared illegal.

4. Modifications or cessation of provision of website services

MEDIALAB reserves the right to partially or completely modify, unilaterally and without prior notice, the provision, configuration, design and content of the website, as well as the terms of use of same and access to services provided.
In addition, MEDIALAB reserves the right to interrupt, temporarily suspend, or cancel www.medialab-prado.es or any of its contents and/or web services at its entire discretion without prior notice, given that use of the website is free and understood to be of promotional value to the users.  Should the situation arise whereby provision of service is to cease, all reasonable efforts will be made to give notice thereof in order that the users may save copies of their publications. This does not in any way annul the users’ responsibility for keeping their own security copies at all times.

5. Intellectual property: reproduction, distribution and public broadcast rights

The contents that MEDIALAB makes available to the user are protected by the intellectual property rights that, where applicable, are held by MEDIALAB and authors, in accordance with prevailing intellectual property law.

Said contents, unless otherwise specified, are licensed under Creative Commons By-SA. This licence can be consulted at this link: http://creativecommons.org/licenses/by-sa/3.0/es/. However, the authors may license their contents under any licence scheme, preferably a free licence scheme, to guarantee wider dissemination. The licence applicable to the content should be clearly indicated on the corresponding publication or work.

Infringement of intellectual property rights by the user will be subject to the application of the related legal liability for any use, except as permissible, that constitutes a violation of those rights.

6. Personal data protection and privacy policy

Visits to www.medialab-prado.es are anonymous. Basic essential personal data must be provided solely by users wishing to access some of the website services

The purposes for gathering and treatment of personal data requested at www.medialab-prado.es are as follows:

  • User identification to provide more personalized attention and to enable participation in forums and projects;
  • Management, study and improvement of services offered;
  • Study and design of new services based on user preferences; and
  • Sending technical and factual information about www.medialab-prado.es and its services, as well as MEDIALAB’s cultural offerings.

Pursuant to Organic Law 15/1999, of 13 December, on Personal Data Protection and Royal Decree 1720/2007, of 21 December, on Personal Data Protection, MEDIALAB guarantees its compliance with the following privacy policy, which governs the collection, storage, treatment and use of personal data provided by the user to MEDIALAB when the user accesses, uses and/or registers with www.medialab-prado.es:

6. Confidential treatment of users’ personal data

The application of the technical and organizational measures needed for the security of personal data and to avoid unauthorized alteration, loss, treatment or access to said data, with consideration of the state of technology, the nature of stored data, and the risks to which they are exposed, arising from human action or the physical or natural environment.

Compliance with security measures related to the facilities, systems and files where personal data are stored, pursuant to the terms of Royal Decree 1720/2007.

Users’ persona data requested upon user registration at www.medialab-prado.es  are treated automatically and included in a persona data file that is the responsibility of MEDIALAB, duly registered with the Data Protection Agency under the name "Usuarios del Portal www.medialab-prado.es" (www.medialab-prado.es Users’ Portal).

Said data must be true, precise, complete and updated, and the user is solely liable for any direct or indirect damages to MEDIALAB or any third party as a result of data that are false, imprecise, insufficient or not updated.

Portal users and visitors will be informed whether it is mandatory to provide the personal data requested on forms to access and register for the services and/or contents provided on the website. This information will be provided at the time of data collection through visual notifications such as floating windows, the placement of asterisks or symbols beside the data requested, or measures similar to the aforementioned. Refusal to provide the data requested, the submission of inexact data or incomplete data, could result in the provision of services and/or contents offered to users and visitors which are improper, inefficient, defective or lacking.

If the user is under age, the user must obtain prior authorization from his or her legal guardian to provide the personal data requested. MEDIALAB is exempt from any liability arising from failure to comply with this requirement. MEDIALAB will never use these data to purposes that are unsuitable to the age of the minor, but rather will use them in accordance with the age, knowledge and maturity of this objective public, and will never collect data related to the economic situation or privacy of the members of the user’s family. MEDIALAB will offer the minor’s parents or guardians the possibility of exercising their rights to access, cancel, correct or oppose the data of their children or charges and will encourage the minors to consult them prior to providing data. Users under the age of 16 should provide MEDIALAB with the written authorization of their parents, guardians or legal representatives, agreeing to the treatment of their data.

The IP address of the user who accesses MEDIALAB’s server, the date and time of access, as well as the pages visited, are stored with said server, and will be collected and stored on a LOG file that will be treated by MEDIALAB to count the visits received by www.medialab-prado.es, as well as to gather statistics.

Personal data provided to MEDIALAB will not be given to third parties without prior authorization by the holder of same, except as expressly stipulated by law, pending compliance with the stipulations of same.

MEDIALAB, in accordance with Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Mail, will under no circumstances sent advertising or communications for sales or other commercial purposes to users unless they have requested it or given their prior consent.

MEDIALAB may modify this privacy policy based on legal requirements, regulations, or to adapt said policy to the instructions mandated by the Spanish Data Protection Agency, which users are advised to visit periodically.

7. Access, correction, cancellation and opposition related to personal data

The owner of the data may exercise his or her rights to access, correct, cancel or oppose same before MEDIALAB pursuant to the terms of data protection legislation. To that end, the owners of said data may send their requests related to personal data protection by electronic mail to info@medialab-prado.es, with “personal data” on the subject line, or by post to the registered address of Medialab Prado, Calle Alameda, 15, Madrid 28014.

8. Applicable legislation and jurisdiction

This legal information is governed by Spanish law. Any disputes that may arise related to its interpretation, application, or compliance with same will be governed by the Courts of Madrid (Spain) and the parties expressly renounce any other jurisdiction which might pertain to them.
